1. Ownership of the website

In compliance with the duty to inform laid down in Article 10 of Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico (LSSI-CE, the Spanish act on information society services and electronic commerce), the following details of the owner of this website are placed on record.

Hereinafter, “Albujon Energy”, “the company” or “the owner”. Any communication concerning this website may be addressed to the postal address or the email address given above.

2. Purpose of the website

This website is informative and institutional in purpose only. Through it, Albujon Energy sets out its identity, its history and the activities it carries out in the field of photovoltaic solar energy, and makes available to the public a form for sending it enquiries.

The site is not a channel for electronic contracting: no products or services are sold through it, no orders are placed and no payments are processed.

3. Nature of the activity

Albujon Energy is a commercial company that develops, takes stakes in and operates photovoltaic installations, committing its own capital. For all relevant purposes, it is expressly placed on record that the company:

• Is not a supervised entity. It is not entered in the registers of the Comisión Nacional del Mercado de Valores (the Spanish securities market commission), the Banco de España (the Bank of Spain) or any other supervisory body, nor is it subject to their supervision.
• Does not provide investment services or the ancillary services listed in Ley 6/2023, de 17 de marzo, de los Mercados de Valores y de los Servicios de Inversión (the Spanish act on securities markets and investment services), nor does it carry out any financial or investment advisory activity or any portfolio management.
• Does not take repayable funds from the public, does not market financial instruments, does not make public offers of securities and does not promote crowdfunding platforms.
• Invests its own capital. When it enters a project it does so as a partner or investor and with its own resources, never on behalf of third parties or with their funds.

Accordingly, no content on this website constitutes a recommendation, an offer, an invitation to invest or advice of any kind. Any figures, periods and considerations that may appear are general and explanatory in nature, and do not replace the specific analysis of each project or the advice of an independent professional.

4. Terms of use

Access to this website is free and unrestricted, and confers the status of user on whoever accesses it. Browsing implies full acceptance of the terms set out in this legal notice, in the version published at the time of access.

The user undertakes to:

• Use the site and its contents diligently, in accordance with the law, good faith and public order.

Access to the site does not entail the waiver, transfer or assignment of any right, other than the use strictly necessary for personal consultation of its pages.

The photographs used on the site come from image libraries with a commercial use licence. Any rights holder who considers that a content item infringes their intellectual or industrial property may report it to the email address given in section 1, and it will be withdrawn or replaced as quickly as possible.

6. Exclusion of liability

The owner endeavours to keep the information published accurate and up to date, but does not guarantee the absence of errors or the permanent validity of the contents, which may be amended without prior notice. The regulatory, technical or economic information set out on the site is general and does not refer to the specific situation of any user.

10. Applicable law and jurisdiction

This legal notice and the relationship between the owner and the user are governed by Spanish law.

For the resolution of any dispute, and where the user is not a consumer, the parties submit to the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that might otherwise apply to them. Where the user is a consumer, the competent jurisdiction is the one determined in each case by consumer protection legislation, and this clause does not limit the rights the law grants to the user.
